Battle Over Paid Surrogacy In New York Has a New “Champion”
Democratic New York Senator Brad Hoylman and his husband David Sigal want to change NY law. Their daughter Silvia, now 4, was born via a surrogate in California, where compensated surrogacy is legal and parental rights are established prior to the birth of the child.
NY’s Child-Parent Security Act #A04319 and S02765
The “Child-Parent Security Act ” has been introduced to legalize compensated surrogacy in New York, and provide “protections” that ensure surrogates are entering into legal agreements and there’s no question that the intended parents of the child have full rights that they paid for.

Of course, also included in the proposed legislation are the already archaic practice of sealing the ORIGINAL BIRTH CERTIFICATE.
(3) ORDERING THAT UPON THE BIRTH OF THE CHILD, A COPY OF THE JUDGMENT 28 OF PARENTAGE BE SERVED ON THE (I) DEPARTMENT OF HEALTH OR NEW YORK CITY 29 DEPARTMENT OF MENTAL HEALTH AND HYGIENE, OR (II) REGISTRAR OF BIRTHS IN 30 THE HOSPITAL WHERE THE CHILD IS BORN AND DIRECTING THAT THE HOSPITAL 31 REPORT THE PARENTAGE OF THE CHILD TO THE APPROPRIATE DEPARTMENT OF 32 HEALTH IN CONFORMITY WITH THE COURT ORDER. IF AN ORIGINAL BIRTH CERTIF- 33 ICATE HAS ALREADY ISSUED, THE COURT SHALL ISSUE AN ORDER DIRECTING THE 34 APPROPRIATE DEPARTMENT OF HEALTH TO AMEND THE BIRTH CERTIFICATE IN AN 35 EXPEDITED MANNER AND SEAL THE PREVIOUSLY ISSUED BIRTH CERTIFICATE.
This is because on most cases, surrogacy law follows adoption law. Even when that adoption law is already crappy and broken.
ethics I have to wonder if Mr. Hoylman is even aware that the law he is proposing will treat any children created as second class citizens and will increase the numbers of New York citizens denied their civil rights.
